The American Trucking Assocations have filed a petition with the U.S. Circuit Court of Appeals for the District of Columbia asking the court to review the Federal Motor Carrier Safety Administration’s latest final rule for hours of service for commercial motor vehicle drivers. New HOS

Looks like the latest final rule for new Federal Motor Carrier Safety Regulations on hours of service may stick. Landline Magazine reports that parties in the most recent lawsuit challenging the regulation have agreed to dismiss the lawsuit. However, that doesn’t mean that a new lawsuit won’t be filed, and it might. Numerous parties are still not happy with the 11th hour of driving.

The final hours-of-service regulation is currently under review at the Office of Management and Budget. Landlinemag.com reports that in a Nov. 28 court filing, the agency states that it expects to issue the final rule within the next 30 days.  The proposed HOS regs were released on Dec. 23, 2010.

Correction: the Federal Motor Carrier Safety Administration published incorrect information regarding the docket number on the reopening of the comment period for the proposed changes to the hours of service. TimekeepingOn 2/1/11, FMCSA  proposed that electronic on-board recorders be required for commercial motor vehicle operators who must keep records of duty status. FMCSA is required to ensure that electronic devices are not used to harass CMV drivers, although they can be used by motor carriers to monitor productivity. In light of recent litigation over this matter, FMCSA is extending the comment period for this proposed rule  to May 23, 2011. To comment, go to the FMCSA Web site and reference Docket FMCSA-2010-0167.

Comment period extended

On February 17, 2011, the Commercial Vehicle Safety Alliance requested that Federal Motor Carrier Safety Administration extend the comment period for the Electronic On-Board Recorder (EOBR) and Hours of Service Supporting Documents Notice of Proposed Rulemaking, which published on February 1, 2011 (76  FR 5537), by 45 days. On March 1, 2011, the American Trucking Associations also requested a 45-day extension to the comment period. The FMCSA has extended the comment period for all comments on the NPRM and its related documents to May 23, 2011. For details, visit the page at EOBR.
